This is an action for violation of sec. 81.15, Stats., and also for private nuisance commenced by the plaintiffs, Wallace
and Evelyn Hoene, against the defendant, city of Milwaukee. The plaintiffs seek to compel the defendant to correct a defective
street condition and to pay for the damage caused by the defective street. The defendant answered and then moved for summary
judgment. The motion was granted, and a judgment was entered dismissing the complaint. The plaintiffs appeal from that judgment. Mr. and Mrs. Hoene own land on which is situated a tavern building at 3955 West Blue Mound Road in Milwaukee. They have owned
the premises since 1952. Shortly after their purchase in 1952, the plaintiffs noticed that the building was shifting. This
shifting has caused the building's foundation walls to crack and has caused similar faults to appear in upstairs floors and
walls. The plaintiffs allege that as a result their real estate has become unsalable.
